Welcome to Friend Tech (“Friend Tech,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Friend Tech mobile application, website, and related services (collectively, the “Service”).
Please read these Terms carefully. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Friend Tech is a social platform designed to help real-world friends connect and communicate. We offer a free, ad-supported tier and a paid Pro subscription that removes ads and adds Pro features. Our goal is to facilitate authentic interactions between people who know one another, without behavioral tracking or the sale of personal information.
You must be at least 13 years old to use the Service—or older if a higher minimum age is required by the laws of your country or region. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet the applicable minimum age requirements, you have the legal capacity and authority to enter into these Terms, and all information you provide is accurate and kept up to date.
You are responsible for maintaining the confidentiality and security of your account, protecting your password and login credentials, and all activity that occurs under your account. You agree not to share your account with others, and to notify us promptly of any unauthorized use of your account or any other security breach.
There is zero tolerance for objectionable content or abusive behavior on the Service. You agree not to:
The Service provides tools to report objectionable content and to block abusive users. We review reports and act on objectionable content and abusive users—including removing content and suspending or terminating accounts—and we may do so at our discretion, as permitted by law. By using the Service you agree there is no tolerance for objectionable content or abusive users.
You retain ownership of any content you create, post, or upload to the Service (“User Content”). We do not claim ownership of your User Content. By posting User Content, you grant Friend Tech a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely for the purpose of operating, providing, and improving the Service. This license ends when you delete your User Content or your account, except for content that has been shared with others who have not deleted it, or where retention is required by law. We will not use your User Content to train artificial intelligence or machine learning models without your explicit, opt-in consent.
Our collection and use of information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have reviewed the Privacy Policy.
We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice. We are not liable to you for any modification, suspension, or discontinuation of the Service, except as required by law.
Friend Tech offers a free tier supported by non-personalized advertising and a paid auto-renewable Pro subscription that removes ads and unlocks Pro features. Pricing and the applicable billing period are shown in the app at the point of purchase.
Subscriptions are sold through the Apple App Store or Google Play. Payment is charged to your App Store or Google Play account at confirmation of purchase. Subscriptions automatically renew for the same period unless auto-renew is turned off at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the end of the current period. You can manage or cancel your subscription, and turn off auto-renew, in your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. Refunds, where available, are handled by the applicable app store under its policies.
If you use the free tier, the Service displays non-personalized ads. These ads are not based on a profile of you, and we do not track you across other companies’ apps and websites. Our handling of advertising-related data is described in our Privacy Policy.
You may delete your account at any time from within the app. We may suspend or terminate your account if you violate these Terms, create risk or legal exposure for us or other users, or for prolonged inactivity, in each case as permitted by law. Upon account deletion, we will remove or anonymize your personal information as described in our Privacy Policy, subject to legal obligations and technical limitations. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will survive.
The Friend Tech and FRiENDS names, logos, software, design, and related materials are owned by Friend Tech LLC and protected by applicable intellectual property laws. These Terms do not grant you any ownership of, or license to, Friend Tech intellectual property except as expressly stated.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRIEND TECH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRIEND TECH LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. IN NO EVENT WILL FRIEND TECH’S TOTAL LIABILITY EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO FRIEND TECH IN THE 12 MONTHS PRECEDING THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US$100). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as liability for fraud or for death or personal injury caused by negligence).
To the extent permitted by law, you agree to indemnify and hold harmless Friend Tech LLC from claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Travis County, Texas, unless applicable law grants you the right to bring proceedings in your local courts.
We may update these Terms from time to time. If we make material changes, we will notify you through the app, by email, or by other appropriate means, and update the “Effective Date” above. Continued use of the Service after the changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Friend Tech regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
